General T&C

1. Applicability

The general terms and conditions of sale and delivery shall apply unless special conditions or written contractual agreements, supplementary or deviating provisions exist. With his order or with the conclusion of a delivery or work contract, the customer acknowledges the binding nature of the general and special contractual provisions, including those concerning the place of performance and jurisdiction. The Purchaser thus waives the precedence of his own contractual terms and conditions.All deviations or additions require a written agreement. 

2. Prices and payment

All prices, including those in the current price list, are recommended retail prices and exclude value added tax (VAT), exclude surcharge for inflation and exclude alloy surcharge. The alloy surcharge (AS) or inflation surcharge (IS) will be charged according to the status on the day of delivery.AS/IS are not subject to discount.Prices, product range and production are subject to change at any time. Our invoices are payable without deduction within 30 days of the invoice date. Packaging and set-up surcharge: the packaging surcharge is charged at CHF 0.80 per metre of strap and the set-up surcharge is charged at CHF 1.00 per container. For orders of packaging units that are not complete, the conditions agreed in each case shall apply. Freight: delivery is usually made by forwarding agent and with a freight charge per order, per packaging / pallet, or per order list due to HVF of 4.0%, or at least CHF 100, which is shown explicitly (construction sites unpaid). Deliveries by freight forwarder are charged on the basis of the tariff ordinance of the Swiss federal state. Commercial Vehicle Association charged. All previous prices and information are hereby invalidated. 

3. Shipping

Whether goods are delivered by post or by truck is at the discretion of the supplier, if possible according to the customer's request. Shipment shall be at the risk of the purchaser or the consignee. The packaging and freight costs as well as the surcharges for express delivery are shown explicitly. 

4. Complaints and claims

Any defects concerning weight, number of pieces and quality of the goods must be notified to the supplier within 8 days after receipt of the consignment; defects which cannot be discovered within this period even after careful inspection must be notified in writing immediately after discovery, at the latest 1 month after receipt of the goods. Our performance, in the case of justified complaints, is limited to faultless replacement deliveries. The customer shall not be entitled to any reduction or compensation for indirect, direct and consequential damages incurred by him or third parties.  

5. Goods returns

Goods purchased in excess or incorrectly will be taken back and refunded by arrangement, provided they are in perfect condition, are listed in a valid price list and are returned within 15 working days of delivery. A contribution towards expenses of at least 30% of the sales price will be deducted. Any loading and transport costs will be invoiced on the basis of the tariff ordinance of the Swiss federal state. Commercial Vehicle Association charged. Defective goods and returns under CHF 200 will not be reimbursed. 

6. Products in special production and call-off orders and confirmed orders

All products not included in the official and valid price lists are considered special products. Orders which are confirmed but not called off or only partially called off shall be considered as special productions and shall be charged. Order cancellation or return of these goods is not possible. We are not obliged to keep all products listed in their price lists in stock. Subject to prior sale. 

7. Delivery dates

Delivery dates are given to the best of our judgement, but are non-binding for us. If binding delivery dates are expressly agreed in our offers, we reject any claim for compensation for non-delivery or late delivery in the event of force majeure and other circumstances for which we are not responsible. 

8. Warranty

As a result of the versatile application possibilities which we cannot control, we cannot give any warranty for the service life of our products. We accept no responsibility for personal injury or damage to property resulting from faults or defects in our products or which are directly or indirectly attributable to the use of our goods. A guarantee for the freeze-thaw resistance of these products can only be given if we have confirmed this property characteristic in our written order confirmations. Colour differences, discolouration or fading, as can occur with any cement-bound product, do not constitute grounds for complaint. We are only liable for advice and recommendations to the extent that we are intentionally at fault. 

9. Copyright, patent and trademark rights

Trademarks, drawings and projects remain our property. It is not permitted to reproduce, use or pass them on to third parties without our express permission. 

10. Place of jurisdiction

Place of performance and jurisdiction for delivery and payment as well as all other mutual obligations is 8772 Nidfurn.
